01Acceptance of Terms

By accessing or using www.exquisvin.com (the “Site”) and related services including vineyard ownership and leasing, estate wine and barrel sales, bespoke bottlings, estate experiences, travel and tours, private events, and Fellowship membership (the “Services”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use the Site or Services.

02Eligibility and Age Restriction

The Services are intended only for individuals eighteen (18) years of age or older, in compliance with Singapore laws relating to alcohol. By registering, you warrant that you meet this requirement and that your use of the Site complies with all applicable laws.

03Fellowship Membership

Fellowship membership and certain Services are extended by application or invitation and are subject to acceptance by ExquisVin. Membership is personal to the named Fellow and may not be transferred or assigned without our prior written consent. ExquisVin may decline an application, and may suspend or withdraw membership for breach of these Terms, misuse, or fraud.

04Orders and Sales

Orders placed through the Site or with our team are subject to acceptance by ExquisVin. A contract of sale is formed only when ExquisVin confirms an order in writing. Prices are confirmed at the time of order, and payment must be made within the stated timeframe. Failure to pay may result in cancellation of the order and forfeiture of any deposit. Where ExquisVin facilitates a sale between an estate and a buyer, it acts as an intermediary unless otherwise stated.

05Vineyard Ownership, Leasing, Bottlings & Experiences

Vineyard ownership, vineyard leasing, and personalised bottling are governed by separate written agreements. ExquisVin does not guarantee harvest yield, quality, or continuity, as these depend on agricultural and natural factors outside our control.

Estate experiences, travel, tours, and private events are offered subject to availability and confirmation by the estate, and may be governed by separate booking terms.

06Prices, Payments & Taxes

Unless otherwise specified, all prices are in Singapore Dollars (SGD). Payments must be made through authorised payment channels, including bank transfer, PayNow, and authorised card payment providers. Buyers are responsible for applicable duties, excise, and import taxes.

07Storage, Delivery, Collection & Risk

Wine may be held in the estate cellars in the owner's name until delivery or collection is requested. Delivery terms are communicated when an order is confirmed. Where delivery is requested, shipping, duties, taxes, and insurance are arranged on the buyer's behalf and billed at cost. Risk transfers to the buyer upon delivery to the agreed address or upon collection. ExquisVin is not liable for customs delays, refusal of entry, or seizure in the destination jurisdiction.

08Intellectual Property

All content on the Site, including text, images, logos, and software, is owned by ExquisVin or its licensors. You may not reproduce, distribute, or exploit such content without prior written consent.

09Prohibited Uses

You may not: (a) use the Site for unlawful purposes; (b) misrepresent identity, submit false information, or engage in fraud; (c) attempt to interfere with Site security; (d) copy, distribute, or reverse-engineer Site code or content.

10Limitation of Liability

To the fullest extent permitted by law: ExquisVin shall not be liable for indirect, incidental, or consequential losses (including loss of profit, opportunity, or goodwill). Nothing excludes liability for fraud, wilful misconduct, or obligations under applicable Singapore law.

11Indemnity

You agree to indemnify and hold harmless ExquisVin, its directors, officers, and employees against all claims, losses, damages, or costs arising from your breach of these Terms or misuse of the Services.

12Links to Third Parties

The Site may contain links to third-party websites. ExquisVin does not endorse or accept responsibility for such sites, and access is at your own risk.

13Termination

ExquisVin may suspend or terminate your access immediately upon breach of these Terms. Upon termination, your right to use the Site ceases immediately, but accrued obligations (including payment) survive.

14Governing Law & Jurisdiction

These Terms shall be governed by the laws of Singapore. You agree to submit to the exclusive jurisdiction of the Singapore courts for any dispute arising from or related to these Terms.

15Amendments

ExquisVin may amend these Terms at any time by updating this page. Continued use of the Site after amendments constitutes acceptance of the revised Terms.

16Refunds, Returns & Cancellations

16.1 Wine & Barrel Sales: For direct purchases of wine and barrels, orders may be cancelled within 24 hours of confirmation, provided the order has not been dispatched. Once dispatched, sales are final and non-refundable, except as required by law.

16.2 Faulty, Damaged, or Incorrect Goods: If wines are delivered in a faulty, damaged, or incorrect state, you must notify ExquisVin in writing within 48 hours of delivery. ExquisVin may, at its discretion, arrange for replacement, credit, or refund, subject to verification. Due to natural characteristics of wine (e.g., cork taint, bottle variation, ullage), ExquisVin does not guarantee taste or drinkability.

16.3 Vineyard Ownership, Leasing & Bespoke Bottlings: Vineyard ownership, vineyard leasing, and custom bottling agreements are governed by separate contracts. Refunds or cancellations are only permitted in accordance with those contracts.

16.4 Refund Method: Approved refunds will be processed using the original payment method within thirty (30) business days.

16.5 Exclusions: No refunds or returns will be provided for: (a) change of mind; (b) improper storage by the customer (heat, sunlight, poor cellar conditions); (c) natural ageing effects (sediment, cork movement).
